The California Supreme Court announced today that they have voted to uphold the Same Sex Marriage Ban voted into law by Proposition 8 in November. The court has decided to allow the 18,000+ existing marriages to stand but has rejected an argument from gay rights activists that the ban revised the California constitution’s equal protection clause to such a dramatic degree that it first needed the Legislature’s approval.
We are happy for the estimated 18,000 gay couples who tied the knot before the law took effect, however we are saddened that the California Supreme Court has chosen to uphold the ban on same sex marriage that was put into effect by the passing of Proposition 8.
Tom Crowe, co-founder of Long Beach Equality, commented on our initial statement on Facebook: ”We have leverage now to fight for equality. Why can 18,000 get married, but we can’t? We’ll get there. Very intelligent pondering from the CA Supreme Court. We now have more ammunition for our fight. 18,000 same sex people are allowed to keep their marriages. THIS IS HUGE FOR OUR FIGHT…. Trust me in looking for the light at the end of the tunnel. Please don’t get discouraged…”
Robin Tyler co-founder of DayofDecision and who, with her wife Diane Olson, was one of the original co-plaintiffs in the suit that initially made same sex marriage possible, issued the following statement today, “Even though our marriage is preserved by today’s decision, we take no joy in the fact that marriage equality for almost everyone else has been removed from our state,” said Tyler. “No civil rights movement has EVER lost. Never. It is not a matter of if our community will win full equal rights, including marriage. It is only a matter of when. But as in all civil rights movements, we will have to fight like hell for it.”
