In a ruling just issued by California Federal Appeals' 9th Circuit, the California ballot measure proposing to outlaw gay marriage in california, AKA Prop 8 has been ruled unconstitutional.
Prop. 8, passed in November 2008, declared marriage to be the union of a man and a woman. It repealed a May 2008 state Supreme Court ruling that had legalized same-sex marriage in California.
Todays ruling says that "a state can't revoke gay rights solely because a majority of its voters disapprove of homosexuality."
California and Long Beach Elected Officials alike have already taken to Twitter to announce their satisfaction with the ruling. Long Beach City Councilman Robert Garcia Tweeted his sentiments with the following.
While San Francisco Mayor, Gavin Newsomes' Twitter Timeline looked something like this.
The States Ban on Same Sex Marriage will still be in place while the matter moves to the Supreme Court. We will have wait and see if the conservative leaning supreme court agrees with todays ruling which stated. "Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples," said Judge Stephen Reinhardt in the majority opinion.
"The Constitution simply does not allow for laws of this sort."
What are your thoughts? Should Prop 8 be overturned by the courts? Is it constitutionally right that voters be given the option to vote on a certain groups civil liberties?
